In the latest edition of Yeomans Work, AFJ Senior Justice Fellow Bill Yeomans writes that with midterm elections less than two weeks away, “hundreds of thousands of qualified voters will face barriers established by Republican state officials, and millions more will have the impact of their votes diluted by partisan gerrymandering.” Republicans stand to benefit, Yeomans writes, and in each instance, their advantage was enabled by the Republican-appointed majority of the Supreme Court.

The Cruelty of Brett Kavanaugh
On September 27, Supreme Court nominee Brett Kavanaugh testified before the Senate Judiciary Committee to address Dr. Christine Blasey Ford’s credible sexual assault allegations against him. Since that hearing, much of the focus has been on Kavanaugh’s blatant lies. But Kavanaugh’s performance also laid bare what many had already known: Brett Kavanaugh acts cruelly toward those outside of his elite circle of friends and colleagues. In fact, Kavanaugh’s lack of empathy appears to extend to anyone without a country club membership. It is a central character trait – he has repeatedly demonstrated, throughout his life, a callousness that has no place on our highest court.

The Court v. Democracy
Voters who are able to cast ballots on November 6 will participate in a system that has been made far less democratic. By upholding measures that block ballot access, gutting the Voting Rights Act, declining to remedy unconstitutional gerrymanders, and permitting unregulated amounts of money to flow into politics, the Supreme Court has cleared the field for Republicans to limit the franchise and dilute its effect.

The Captured Court
In the aftermath of the Kavanaugh confirmation, Supreme Court justices have taken to public fora to assert the independence of the Court and to assure the public that the Court is not a political institution. Most prominently, Chief Justice Roberts distinguished justices from officials in the political branches, noting that “they speak for the people” while the justices “do not speak for the people, but we speak for the Constitution.”
